These Terms of Use ("Terms") govern your access to and use of the websites, mobile applications, online platforms and digital services operated by Safer Charging Limited.

By accessing or using our Services, you confirm that you have read, understood and agree to be legally bound by these Terms.

If you do not agree to these Terms, you must not use our Services.

1. Definitions

"Company", "Safer Charging", "we", "us" and "our" means Safer Charging Limited together with its trading names including but not limited to:

  • ChargeSafe

  • Arcane Charging Network

  • Arcane Charging Academy

"Services" means all websites, mobile applications, software, online platforms, APIs, reports, databases, digital products and associated services operated by us.

"User" means any individual or organisation accessing or using the Services.

"Content" means all text, graphics, images, inspection reports, software, databases, documents, forms, videos, methodologies, scoring systems, algorithms, source code, layouts and other material made available through the Services.

2. Eligibility

You must:

  • be at least 18 years old;

  • have legal capacity to enter into contracts;

  • provide accurate information;

  • comply with these Terms.

If using the Services on behalf of an organisation, you warrant that you have authority to bind that organisation.

3. Changes to these Terms

We may amend these Terms at any time.

Updated Terms become effective when published unless otherwise stated.

Continued use of the Services constitutes acceptance of any amendments.

4. Access to Services

We may:

  • modify Services;

  • withdraw Services;

  • suspend Services;

  • discontinue features;

  • introduce new features;

  • restrict access;

  • require software updates.

We do not guarantee uninterrupted availability.

5. User Accounts

Where accounts are required you must:

  • maintain accurate information;

  • keep passwords confidential;

  • use strong passwords;

  • notify us immediately of suspected compromise.

You are responsible for all activity undertaken using your account.

6. Acceptable Use

You agree not to:

  • infringe intellectual property;

  • upload unlawful material;

  • interfere with security;

  • attempt unauthorised access;

  • harvest data;

  • copy inspection reports;

  • copy scoring methodologies;

  • copy audit methodologies;

  • reverse engineer software;

  • decompile applications;

  • use automated extraction tools;

  • circumvent security controls;

  • overload systems;

  • impersonate another person;

  • create multiple fraudulent accounts;

  • interfere with inspections;

  • submit false information;

  • manipulate inspection outcomes.

7. Mobile Application Permissions

Where using our mobile applications you acknowledge that we may require access to:

  • camera;

  • photographs;

  • GPS location;

  • storage;

  • internet connectivity;

  • notifications.

Certain functionality will not operate correctly if permissions are disabled.

8. Inspection Data

Users conducting inspections agree that:

inspection records must:

  • be accurate;

  • be honest;

  • represent genuine observations;

  • not be falsified;

  • not be manipulated.

Submitting deliberately inaccurate inspection data constitutes a material breach of these Terms.

We reserve the right to verify inspections using:

  • GPS information;

  • timestamps;

  • photographs;

  • metadata;

  • audit trails;

  • account history.

9. Fraud Prevention

We may investigate suspected:

  • fraud;

  • misuse;

  • identity theft;

  • impersonation;

  • account sharing;

  • data manipulation;

  • attempted circumvention of controls.

Where appropriate we may:

  • suspend accounts;

  • terminate access;

  • remove data;

  • notify customers;

  • notify authorities;

  • pursue civil remedies.

10. Intellectual Property

Unless expressly stated otherwise, all intellectual property rights in the Services remain exclusively owned by Safer Charging Limited or its licensors.

This includes but is not limited to:

  • ChargeSafe

  • Arcane Charging

  • Arcane Charging Academy

  • logos

  • trademarks

  • branding

  • inspection methodologies

  • assessment frameworks

  • scoring systems

  • accessibility methodologies

  • fire safety methodologies

  • software

  • source code

  • databases

  • reports

  • templates

  • forms

  • images

  • graphics

  • documentation

  • videos

  • learning materials

  • website layouts

  • application interfaces

  • APIs

  • algorithms

  • datasets.

No ownership rights are transferred to users.

11. Prohibited Commercial Use

Without our prior written consent you must not:

  • reproduce our methodologies;

  • reproduce inspection criteria;

  • reproduce assessment forms;

  • reproduce report formats;

  • reproduce scoring systems;

  • reproduce training materials;

  • build competing products using our data;

  • create derivative works;

  • use our inspection framework commercially;

  • resell reports;

  • licence our data;

  • redistribute datasets.

12. Artificial Intelligence Restrictions

You must not use any part of the Services, including Content, databases, inspection reports, photographs or methodologies:

  • to train artificial intelligence systems;

  • to develop machine learning models;

  • to create synthetic datasets;

  • to reproduce our methodologies;

  • to generate competing products.

This restriction applies whether undertaken manually or through automated systems.

13. Database Rights

Our inspection databases and associated datasets are protected by UK and international database rights.

You must not extract or reutilise substantial parts of any database without written permission.

Repeated extraction of insubstantial amounts intended to recreate our databases is also prohibited.

14. User Content

You retain ownership of content you submit.

However, you grant Safer Charging Limited a perpetual, worldwide, non-exclusive, royalty-free licence to:

  • store;

  • copy;

  • reproduce;

  • adapt;

  • analyse;

  • distribute;

  • publish where necessary;

  • process;

  • display.

solely for operating, improving, securing and delivering our Services and fulfilling contractual obligations.

You warrant that:

  • you own the content or have authority to upload it;

  • it does not infringe third-party rights;

  • it is lawful.

15. Inspection Reports

Inspection reports represent professional assessments based upon conditions observed at the time of inspection.

Reports:

  • are not guarantees;

  • are not engineering certifications unless expressly stated;

  • may become outdated;

  • should not be relied upon indefinitely.

Users remain responsible for their own operational, legal and safety decisions.

16. Third Party Information

The Services may reference:

  • charge point operators;

  • manufacturers;

  • mapping providers;

  • government information;

  • public datasets.

We do not guarantee the completeness or accuracy of third-party information.

17. Availability

The Services are provided on an "as available" basis.

We do not guarantee:

  • uninterrupted access;

  • error-free operation;

  • compatibility with every device;

  • permanent availability.

18. Cyber Security

Users must not:

  • test vulnerabilities;

  • conduct penetration testing;

  • attempt denial-of-service attacks;

  • exploit bugs;

  • interfere with infrastructure.

Any suspected vulnerability should be reported responsibly.

19. Suspension

We may suspend access immediately where we reasonably believe:

  • these Terms have been breached;

  • fraud has occurred;

  • security is threatened;

  • unlawful activity is suspected;

  • our intellectual property is at risk.

20. Termination

We may terminate accounts without notice where users materially breach these Terms.

Termination does not affect accrued legal rights.

21. Disclaimer

Except where prohibited by law, the Services are provided "as is" and "as available".

To the fullest extent permitted by law we exclude all implied warranties including:

  • merchantability;

  • fitness for purpose;

  • uninterrupted operation;

  • accuracy;

  • completeness.

22. Limitation of Liability

Nothing in these Terms excludes liability for:

  • death or personal injury caused by negligence;

  • fraud;

  • fraudulent misrepresentation;

  • any liability which cannot legally be excluded.

Subject to the above, Safer Charging Limited shall not be liable for:

  • indirect losses;

  • consequential losses;

  • business interruption;

  • loss of profits;

  • loss of contracts;

  • loss of goodwill;

  • reputational damage;

  • loss of data;

  • loss of anticipated savings;

  • economic loss.

Where liability cannot be excluded, our aggregate liability shall not exceed the total fees paid by the relevant user during the twelve months preceding the event giving rise to the claim, unless otherwise required by law.

23. Indemnity

You agree to indemnify and keep indemnified Safer Charging Limited against all losses, liabilities, costs, damages and expenses arising from:

  • breach of these Terms;

  • unlawful use of the Services;

  • infringement of third-party rights;

  • misuse of inspection data;

  • fraudulent activity.

24. Confidentiality

Users receiving confidential information agree not to disclose it without written consent except where required by law.

25. Privacy

Personal data is processed in accordance with our Privacy Policy.

26. Third Party Platforms

Where our mobile applications are distributed through:

  • Apple App Store;

  • Google Play;

  • Microsoft Store;

those platforms are not responsible for:

  • support;

  • maintenance;

  • warranties;

  • claims relating to the application.

Your use of the application must also comply with the applicable platform terms.

27. Force Majeure

We shall not be liable for delay or failure caused by circumstances beyond our reasonable control including:

  • natural disasters;

  • war;

  • terrorism;

  • cyber attacks;

  • utility failures;

  • internet outages;

  • industrial disputes;

  • governmental action.

28. Severability

If any provision is found unenforceable, the remaining provisions remain in force.

29. Entire Agreement

These Terms, together with any applicable service agreement, Privacy Policy, Cookie Policy and any specific product terms, constitute the entire agreement governing use of the Services.

30. Waiver

Failure to enforce any provision does not constitute a waiver of that provision.

31. Governing Law

These Terms shall be governed by the laws of England and Wales.

32. Jurisdiction

The courts of England and Wales shall have exclusive jurisdiction to determine any dispute arising from these Terms, except where mandatory consumer protection legislation provides otherwise.
